GENERAL MEDIA RELEASE FOR HEALTHY KIDTCHENTM
I hereby acknowledge and grant to Michele Kaplan, MS, RD, CDN and Healthy KIDtchenTM, its
parents, subsidiaries, licensee and assigns, members, directors, officers, employees, volunteers,
representatives, and agents (collectively, the “Creator”) and all persons, firms or entities deriving rights
from the Creator, the non-exclusive, royalty free, worldwide right to use the undersigned’s, name,
likeness, voice or other identifying material (collectively “Identifying Material”), in connection with its
website, and any other use the Creator may choose to make of the Identifying Material in connection
with the promotion of the website and services offered on such website. I further release the Creator
from any and all present and future claims for equitable and legal relief and for compensation for the
use, in any media, now known or hereafter developed, of the Identifying Material, as originally created,
or as modified, altered, edited or amended as determined by the Creator. The Creator’s rights shall
include, without limitation the right to use the Identifying Material on such social media channels,
including, without limitation, Instagram, Twitter, Facebook, Pinterest, Podcasts and any form of media,
as the Creator may determine.
I hereby further release and discharge the Creator in perpetuity from any and all claims and demands and
waive and forego any and all legal or equitable actions arising out of or in connection with the use of the
Identifying Material.
I acknowledge and consent on behalf of the minor child that the Creator is the owner of the Identifying
Material as created by the Creator, including any video, recording, photographs, illustrations or other
format, which includes the Identifying Material, the copyrights pertaining thereto and any and all other
rights, benefits or privileges arising therefrom, now and hereafter without limitation. I hereby assign to
the Creator all rights under copyright and otherwise to the works created which include any Identifying
Material.

LIABILITY FOR HEALTHY KIDTCHENTM
ALLERGY DISCLAIMER: Michele Kaplan, MS, RD, CDN, its parents, subsidiaries, licensee and
assigns, members, directors, officers, employees, volunteers, representatives, and agents (collectively,
the “Creator”) make every attempt to identify all ingredients in their recipes. In addition, the Creator will
flag recipes with possible allergen-containing ingredients; however, there is always a risk of
contamination. You must make the decision of enrolling your child in this class based on the information
provided and the possible health risk. There is also a possibility that manufacturers of the commercial
foods used by the Creator could change the formulation at any time and without notice. Customers with
any food-related concerns need to be aware of this risk and use brands known by the customer to be safe.
I understand that the Creator will seek to eliminate exposure and risk to my child but agree that the Creator
assumes no liability for adverse reactions for food consumed or items that my child may come in contact
with while participating in this class.
ACCIDENT WAIVER AND RELEASE OF LIABILITY: I HEREBY ASSUME ALL OF THE
RISKS FOR MY CHILD OF PARTICIPATING IN THIS CLASS, including by way of example and
not limitation, any risks that may arise from negligence or carelessness on the part of the Creator, from
dangerous or defective equipment or property owned, maintained, or controlled by the customer, or
because of any possible liability without fault on the part of the Creator. I certify that there are no health-
related reasons or problems, which preclude my child from participation in this class. I acknowledge
that this Allergy Disclaimer, Accident Waiver and Release of Liability Form will govern my child’s
actions and responsibilities in the class. In consideration of permitting my child to participate in this
activity, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and
assigns as follows:
I WAIVE, RELEASE, AND DISCHARGE from any and all liability, including but not limited to,
liability arising from the negligence or fault of the entities or persons released, for my child’s
death, disability, personal injury, property damage, or actions of any kind which may hereafter
occur to my child from this class. I acknowledge that the Creator is NOT responsible for the errors,
omissions, acts, or failures to act of any party or entity conducting a specific activity on their
behalf. I acknowledge that this class may involve certain risks and carries with it the potential for
death, serious injury, and property loss. The risks include, but are not limited to, those caused by
trade tools and reactions to allergens. The Allergy Disclaimer, Accident Waiver and Release of
Liability Form shall be construed broadly to provide a release and waiver to the maximum extent
permissible under applicable law.
